Labor and Employment Laws Essay

Human resource departments are responsible for effectively, legally, fairly, and consistently attempting to maximize an organization’s return on its human capital investment while minimizing financial risk. This is why labor laws and Civil Acts are placed in the work place and other felicities to insure the well fare of others are without risk and effective(WGU). Analysis of Situation A In every situation all bases need to be covered and all information gathered before any request is finalized. It is necessary to establish whether the employee qualified for the leave and whether the terms as stipulated under the Family and Medical Leave Act of 1993 (FMLA) were actually met. The Act requires that for one to benefit from the leave he or she must have worked with the employer for more than 12 months. Employee A had worked for 2 years and it can be deduced that he had successfully completed at least 1250 hours at the work place. The rationale of the law is to make it possible for one to accomplish his professional obligations and personal ones without having to choose one at the expense of another. The reason for the leave must be for the care of a family member who has a serious health condition or one’s own health condition. Employee A asked for the leave to take care of his wife who had prematurely given birth to twins. In fact, this is one of the reasons listed in the FMLA for this type of leave. It is not difficult to discern that this is a serious medical condition which requires continuous care of the patient. Therefore, employee A should not be subjected to any victimization upon his request of leave. Focusing on the duration of the leave, an employee is entitled to up to 12 weeks of this type of leave, so long as the right paperwork is provided. Employee A had been out for 11 weeks, hence, was still within the statutory period of 12 weeks. Since the issue of paper work is not a concern under this situation, I have confidence that he supplied all the required documentation. The employee must be reinstated to the same position he held before the leave, so long as he  still is able to perform the essential function of the job. Employee A was still able to perform the functions of the job. Hence, he was reinstated to his former position. On the issue of pay during the leave, the Act does not require employers to pay the employees during the leave but any arrangement to the contrary must, however, be respected. Since, there was no agreement to this effect with the employer; the manager is under no obligation to pay the withheld salary for the 11 weeks. The new manager in withholding the salary did not breach any law and this decision cannot be properly said to be discriminatory laws, in this case FMLA (Lau & Lisa, 2013). Analysis of Situation B General laws of Human Rights are captured in the U.S. constitution. The Civil Rights are contained in the Civil Rights Act of 1964. The specifics of employment law are contained in various federal statutes that address specific issues in employment law. The employment law to be considered in the current situation is the Age Discrimination in Employment Act of 1967 (ADEA). The brief statement of the facts regarding employee B is that he was 68 years of age and had served Company X for 42 years and was assessed to be above average on his performance. He was allegedly not promoted because of his age with the company preferring a younger employee of 32 years who received a performance review of adequate. First of all, Company X is bound by the Act, since it had 75 employees which is way above the minimum requirement of 20 employees. As such, Company X in hiring, promoting or firing its employees must pay due regard to the requirements of the Act. Secondly, employee B is currently 68 years old, meaning that he is protected by the Act which states that it protects workers above the age of 40. If the assessment of both employees revealed that the older one was still performing better than the younger one then it would be hard to find a genuine reason for the promotion of the younger employee. Additionally, the situation does not fall under the exception of Bona Fide Occupational Qualification (BFOQ) stipulated in the Act. Under this exception, a younger employee can be preferred to an older one if it is objectively established and to some extent obvious that the job cannot be effectively performed by the older employee. In view of the foregoing, I rest upon the conclusion  that there was discrimination on the basis of age in selection of the younger employee for the promotion at the expense of employee B. The fact that the employee was not asked to sign an ADEA waiver or any document to the effect confirms my position. Age was the ‘but for’ reason for lack of promotion of the employee (Lau & Lisa, 2013). Analysis of Situation C The only purpose that Company X gave for failure to hire employee C was that such a move would have been costly to the company. Therefore, I would assume that the employee was qualified for the job as the applicable statue (Americans with Disabilities Act of 1990) applies to qualified but disabled persons. Consequently, it cannot be doubted that employee C was qualified for the job. Secondly, the Act gives considerations of whether the disabled person can perform the essentials of the job. Under this test it would be understandable when a company fails to hire a blind person as a driver. This is impossible since such a person cannot perform the essential functions of the job. Accordingly, the Act also permits the failure to hire a disabled person if it will require reasonable accommodation in order to perform the job. The essential function of the job would be incompatible with employee C’s situation and as such the level of accommodation required was too high. Company X’s decision not to hire employee C does not amount to discrimination but an instance of genuine distinction. The adjustments needed to accommodate employee C would be too much and, therefore, the decision not to hire him is not discriminatory against him. As a result, employees are more protected since they are the fragile parties in the employment contract bargain. This is because employees can be exploited by ill-intentioned employers. As such employment laws together with other human rights laws take care of employees. The laws also protect the interests of employers by lining the duration of certain leaves, qualifications for some benefits as discussed above and hiring of employees on the basis of merit and not any other considerations. The analysis of the aria â€Å"Lascia ch’io pianga† by Haendel according to the thorough bass method, shows us how the composer refer in this piece to the typical compositional procedures of baroque music. The aria starts with a pedal (frame, according to Joel Lester’s terminology) followed by a cadence harmonized according the regle de l’octave both in ascending and descending motion (MM. 5-8). The second episode starting at M. 8 consists of a sequence, precisely a modified sequence, in which the subsequent is slightly modified at the end introducing a new harmony on the second beat of M. 12 that leads to a final cadence with a modulation to the original key. The regle is always working also in the sequence, it is just applied chromatically according the harmonic context. After two repetitions of the first phrase, with a small difference in MM. 17 and 34 with a 6-chord instead of a 5-chord on the second subdivision of the second beat, we have the last section of the aria, before the da capo. In this last section there is a modified sequence (MM. 35 to 39) followed by a cadence that leads to the end of the piece. In general, most of the harmonies in the piece reflect the indications of the regle but there are some exceptions. The most interesting part in which the regle is not applied is at the very beginning of the aria: the use of 7 on the second degree, instead of 6. This is the harmony that more that any other characterizes this piece, giving a smoother flavor to the passage than the dominant harmony suggested by the regle. Aside from the exception, it is interesting to see where Haendel follows strictly the regle, and this happens in every final cadence, probably as a sign that in the closing sections the use of the regle is more functional and gives a stronger sense of harmonic definition. In the fundamental bass, the bass line consists of a series of roots that not only represent the roots of the harmonies built on top of then, but also physically generates these harmonies. Any kind of harmony should be reduced to triads and sevenths and the motion of the bass-line should be by fifths and fourths. In â€Å"Lascia ch’io pianga† is possible to understand all the harmonies as fifths and sevenths but the bass-line motion not always moves naturally by fifths and fourths. In many cases, through the use of the double-emploi, is has been possible to correct some irregular motions into fifth motion, but still for some of them it hasn’t been possible. Probably the most evident example is the motion by second occurring between MM. 6 and 7, and between MM. 11 and 12. The fundamental-bass analysis bring into play notes that are supposed, that are not in the score but affect the music as the roots of a tree feed the last leaf on the highest branch. In this case, we can see how the sense of motion that we perceive listening to this aria is perfectly explained and justified by the succession of seventh chord and fifth chord, as the epitome of the arsi-tesi feeling in music. Even in the first two measures, that look really simple in the thorough bass analysis, we can still discover something that makes this beginning not so obvious. In the first measure the F is transformed into D with a seventh chord on top, and the accumulation of this seventh with the next one in the second measure create a sense of instability and a need to resolve. In the next measures this tension will be released through a succession of 5-chord with two final combinations 7-5 to close the episode.

Why did the US find it impossible to defeat the Vietcong?

There were a number of problems facing US forces when fighting the war in Vietnam. Perhaps one of the biggest problems that they faced was the fact that the Vietcong were fighting using guerrilla tactics: fighting on a small scale, taking independent, irregular actions.The Vietcong depended on stealth, concealment, and surprise attacks and ambushes. Guerrilla warfare spread as Vietminh soldiers who were trained and armed in the North – the Vietcong, returned to their homes in the south to assassinate, ambush and sabotage. Unlike conventional wars in which the Americans may have fought, the war in Vietnam had no defined front lines. Much of the fighting consisted of hit and run attacks, with the guerrillas striking at government outposts and then retreating into the jungles.Most of the US soldiers were also caught out by booby traps set up by the Vietcong. These ranged from simple holes in the ground to metal spikes covered in poison or human excrement. Despite their sophistica ted weapons, the Americans could not eradicate the skillful and determined rebellions of the Vietcong.Another thing that made fighting the war difficult for the Americans was the uniform that the Vietcong wore. Their uniforms consisted of black pajamas and shirts, with straw hats. This led to a great lack of trust among the Vietnamese and the Americans, as they were unable to distinguish between real Vietnamese civilians and Vietcong soldiers in disguise.The Vietcong were also able to remain well hidden with their extensive underground tunnel system, which reached 250 kilometers in length. There were underground kitchens, weapon stores, dormitories, hospitals and rest areas. These tunnels made it increasingly difficult for the US forces to find the Vietcong.By 1966, the Americans began a series of ‘Search and Destroy Missions' in order to hunt down the Vietcong. The problem was that, by doing this, they began to loose the trust of, and ‘alienated' the Vietnamese civilian s. More importantly the American public began to doubt whether or not they were the ‘good guys’ in this war and grew increasingly dissatisfied with the nations war policy. The American government began losing the support of the public once they witnessed reports about the war and events such as the My Lai massacre.The unfamiliar terrain and conditions in Vietnam also made life more difficult for the US forces. The intense heat made it difficult for them to see where they were going, carry weapons and move swiftly. As much of Vietnam was covered in jungle, swamp and paddy fields, it soon became clear that the terrain was unsuitable for tanks.

There is not only one set list of criteria that is used to determine whether to make a hire or not, it relies on a whole lot of different factors. My biggest challenge is that I have lots to do but very little time to complete it. There are not enough hours in the day. Another challenge is that I may have too many positions to work on. Finally, being able to find the right skill set to fill tech roles can prove to be a big obstacle. Internally it is a group decision because there needs to be a consensus among the group. Reflecting On The Incident And Making Necessary Application Of Theory Introduction The aim of this assignment is to identify and reflect on a critical incident that happened at my work place and making an analysis for learning experience. The following will be identified and defined: critical reflection, the value of critical reflection and health and social care theories to support my personal and professional development. The full description of the incident is available in Appendix.1. White et al (2006) defines critical reflection as a process which incorporates individuals analyses of thinking with regard to the influence of socially dominant thinking. The material reflected upon in critical reflection is screened through the analysis based on critical theory. Foook, (2002) in Pranee Limputtong (2008 p.266) points out that critical reflection is a process of identifying the ways in which we might unwittingly affirm discourses that work against us, and shape people we are working with through examining our implicit assumptions. The value of reflection is to generate evidence to confirm or contest the link between reflection and improvement in social care work practice and also has a potential to enhance the quality of care delivery (Burns and Bulman 2000). Reflection stems out of particular experiences of professionals, including their experiences of critical reflection in some of health subjects such as social care and social work. Critical reflection seeks out to engage professionals into their studies making them aware of situations that may have noticed and taken for granted in practice. The method of critical reflection is also interrogating and debating the aspects of a particular practice in order to generate an understandable study (White et al 2006). According to Palmer et al. (1994) reflection has been proven to be a key tool for practice learning, practitioners need more than experience knowledge for competence. Professional development is a way of equipping practitioners to be competent and be in a better position to respond well to changing needs in the world of practice. Pranee Limputtong (2008 p. 266) states that the reasons or aims of critical reflection is to dig how we participate in communicating our ideas which shape the existing power in relations. Johns and Freshwater (1998) cited in based learning.org (2008) points out that, the value of reflection is a way in which professionals can enhance their learning as it involves questions about self, actions beliefs and values. There are several models of critical reflection, only a few have been identified in this assignment. Kims (1999) model is a three phase of reflection which helps the practitioner to continue the journey of reflection as he or she gradually develops the abilities to reflect. This model is used to develop a novice reflective practitioner to begin with simple descriptive reflection and gradually progress to the more complex levels under close supervision and guidance (Rolfe et al 2001). Johns (2000) model for reflection is a cue of questions built into a very comprehensive framework for structuring reflection-on-action furthermore Rolfe et.al (2001) states that some consideration should be made, whether his fifth way of knowing of reflexivity is really reflective. His model does not make any provisions for making changes to an on-going experience. Gibbs (1988) model of reflection a cyclical cue of questions arranged in the similar way with Tandiwe Dube 0921769 Johns (2000) learning cycle. This framework is centred in learning from experience rather than attempting to change the experience. The model does not encourage any reflexive path back to the action from which learning is derived (Rolfe et al 2001) I have chosen this framework as it gives the foundation of reflection and has three cues of questions that are designed to be open and can be revised to meet specific needs for different practitioners in different situations. It pays particular attention to Bortons (1997) model as its macro structure. The three set of questions completes a cycle which enables the practitioner to continually improve on learning from experience for better practice. The first set of questions is the description level of the situation. The second level is the building level of reflection where the practitioner is encouraged to make a personal theory and knowledge out of the situation. The third level is for the practitioner to reflect on the consequences of their actions and considers how to improve on practice. This final stage is considered as the stage which can contribute more to practice (Rolfe et al 2001). Mr. B. was not offered his cup of tea and toast in the morning as he was incontinent of urine and faeces and needed to attend to his personal hygiene before being offered a cup of tea. This interrupted with his normal routine in the care plan which made him unhappy. As Mr. B was coming downstairs my colleague shouted from upstairs that I should ask Mr. B to go back to his bedroom. ( See Appendix) I used my voice and hand gestures to tell him to go back upstairs (Mr. B has learning difficulties), but he did not respond and continued coming down towards me. I felt intimidated and scared as I could not get through to Mr. B. I was concerned and I thought of my responsibility of duty of care, personal hygiene, respect, Tandiwe Dube 0921769 privacy and dignity as he was not appropriately dressed to come downstairs. I could tell that Mr. B was not listening to what I was saying as he seemed to be furious then hit the fish pond with his fist out of anger. Nazarko (2004) suggests that one should not repeat if the person does not understand what is being said but try to rephrase and speak a little more slowly when communicating with the service users. The way I raised my voice trying to be assertive and the way I used my hand gestures was wrongly interpreted by Mr B. In the process I have learnt that as a bank staff every time I get to a particular residential/care home, I need to first read the service user care plans before giving any nursing intervention to avoid putting myself and others to any risks as there might be changes in the service users care needs. As a social care worker, according to the GSCC (2002) I am accountable for the task delegated to me as well as my actions of carrying out the task. I should also identify my training needs as stated by Palmer et al (2000) that many practitioners suggested that reflection had encouraged them to identify their learning needs, assess their level of competence examine their accountability and articulate their concerns before undertaking a new task. When I saw that there was communication breakdown between myself and Mr. B, I should have called my senior, the manager or one of my colleagues before Mr. B hits the fish pond and gets hurt. According to the GSCC (2000) as a social care worker I have to work with others to protect the health and wellbeing of those in my care, seeking assistance from the employer or appropriate authorities if one feels not adequately able to carry out any task or not sure how to proceed. If this ever happened again I will call for assistance immediately when I realise that I am not Tandiwe Dube 0921769 competent to deal with the situation. As a practitioner I should recognise the limits of my professional competence and only undertake a task and accept accountability of those activities that I am competent in doing. In future I will make sure that I undertake necessary training to build my competence. To practice competently one needs the knowledge, skills and the required ability to lawfully, safely and effectively carry on a task without direct supervision. The senior came after hearing the noise and she spoke to Mr B using both verbal and non-verbal communication de-escalation technique. Through this incident I have learnt to continue developing my knowledge and skills as it is a requirement for every practitioner to take fresher courses to keep their knowledge and skills up-to-date. In conclusion critical reflection is quite important as it seeks out to engage professionals into their studies making them aware of situations that they may have noticed and taken for granted in their practice. Also the value of reflection is vital to generate evidence to confirm or contest the link between reflection and improvement in nursing practice and also has a potential to enhance the quality of care delivery (Burns and Bulman 2000). Structure of banking in India The Indian banking system is classified into scheduled and non-scheduled banks. The scheduled banks are then classified as state cooperatives banks and commercial banks. The non-scheduled banks are classified as central cooperative banks and primary credit societies and the commercial banks. Commercial banks are classified in both the scheduled banks as well as the non-scheduled banks. Schedule banks are those which are included in the SECOND SCHEDULE of BANKING REGULATION ACT 1956. The business per employee for foreign banks has showed a tremendous increase from Rs974.77 lakhs in 2006-07 to Rs1559.74 lakhs in 2011-12. The business per employee for the private banks has also increased from Rs695.23 lakhs in 2006-07 to Rs823.26 lakhs in 2011-12. Profit per employee: The profits per employee are the highest in foreign banks followed by new private sector banks in 2011-12. Financial Soundness: The CAR(Capital Adequacy Ratio) is the most important indicator of financial soundness of banks. The capital to risk weighted assets ratio is shown is the figure below. The CRAR of public sector banks has been between 12 and 15 percent. The old private sector had CRAR lying between 12 and 15 percent. The new private sector had CRAR of more 15 percent. It goes the same with the foreign banks for the year ending in March 2012. 9 Asset Quality: the asset quality of a bank is shown by level of non-performing assets (NPAs). Better quality of assets is the indicator of efficiency. There is a vast improvement in the efficiency of Indian banks. B1 The NPAs as percentage of Average Total Assets are increasing marginally in 2011-12. The NPA of foreign banks rose from 0.8 in 2009-10 to 1.4 in 2010-11 to 1.6 in 2011-12. Daisy Miller starts out in a hotel in Vevey, Switzerland when a gentleman named Winterbourne meets Daisy, a young, beautiful American girl traveling through Europe. Daisy, her younger brother Randolph and her mother, Mrs. Miller, are traveling all over Europe while her father is home in Schenectady, New York. While Daisy is in Europe, she does not accept European ideas to be her own. Winterbourne, to the contrary, has been living in Europe since he left America when he was younger. Winterbourne takes a strong liking to Daisy even though his aunt, Mrs. Costello, does not approve of him even speaking to Daisy. Winterbourne claims that Daisy is an innocent person, but his aunt believes she is too common and not refined enough for him. Winterbourne and Daisy spend much time together, and even had a date at a close by castle named Chillon. Winterbourne then returns to Geneva where he is studying, but agrees to visit Daisy again that winter in Rome. When winter comes around Winterbourne goes to Rome to visit Daisy. While Winterbourne was away Daisy met a suitor named Mr. Giovanelli. Later, when a mutual friend named Mrs. Walker throws a party, Daisy arrives with Giovanelli. Mrs. Walker does not approve of Daisy being seen in public with all of these men and makes the decision to stop speaking to Daisy.
